Terms and Conditions
By placing an order, you confirm that you are eighteen (18) years old or above and capable of giving consent to a contract and you also confirm that you agree to these Terms and Conditions along with our Privacy Policy and Terms of Use.

1. Purchase of Products

1.1. Before making any purchase of goods from Eracare Health Mart Philippines Inc., customers are advised to read carefully the following terms & conditions and make sure it is well understood. Customer is deemed to have accepted these purchase terms and conditions once the Collection Receipt/Sales Invoice/Sales Order is signed.

1.2. The Collection Receipt/Sales Invoice/Sales Order is non-refundable and non-transferable in nature. Any request to terminate the Collection Receipt/Sales Invoice/Sales Order is subject to approval from Eracare Health Mart Philippines Inc., on a case by case basis. Eracare Health Mart Philippines Inc., reserves the right to decline or accept such requests for termination. 

1.3. In the event that Eracare Health Mart Philippines Inc. agrees to terminate the Collection Receipt/Sales Invoice/Sales Order at the request of the customer, a termination fee of 50% of the amount paid by the customer in the Collection Receipt/Sales Invoice/Sales Order will be levied to the customer, all original Collection Receipt/Sales Invoice/Sales Order must return to Eracare Health Mart Philippines Inc. 

1.4. Any deposit paid is non-refundable. In the case that customer fail to pay the balance of the amount of the Collection Receipt/Sales Invoice/Sales Order within 30 days from the date of the Collection Receipt/Sales Invoice/Sales Order OR refuse to take the ordered goods when it is delivered by Eracare Health Mart Philippines Inc., without any reason and continuously failing to provide an alternative date of delivery, Eracare Health Mart Philippines Inc., reserves the right to forfeit such deposit without further notice. 

1.5. You may place an Order by filling up and submitting the Order form and providing the payment details at Gintell website, Lazada, Shopee or in the authorized Physical Stores nationwide. 

1.6. Any Order you make shall be deemed to be accurate, complete, unconditional and irrevocable. Thus, without any other action from you or any notice to you, Seller shall have the right – but not the obligation – to process your Order. Subject to Seller’s discretion, you may request to revise or cancel an order and Seller will strive to accommodate your request on a commercially reasonable effort basis.

1.7. Each Order of a Product shall be subject to Seller’s acceptance at its sole discretion and each accepted Order shall constitute a separate Sales Contract. There are various reasons which may hinder or impact the processing of your Order; thus, the Seller reserves the right to decline or cancel an order for any reason at any given time 

2. Payment

2.1. You may pay for the Product through any of the payment modes allowed by Seller. However, your payment will only be credited or accepted when the Seller accepts your Order. Seller may impose additional terms or change the payment modes at any time at its discretion.

2.2. You agree that you are subject to the user agreement of your chosen payment mode and that you may not hold the Seller liable for any failure, disruption or error made by the service provider of your chosen payment mode.

2.3. Seller will prepare an invoice upon acceptance of the Order and will deliver it along with the Product.

3. Delivery Policy

3.1. The Product shall be delivered to the address specified in your Order. A delivery shall only be made within specified areas in the Philippines. Once designated, the place of delivery shall not be changed unless Seller expressly agrees in writing.

3.2. The charges for packing and delivery shall be as stated in the Order form.

3.3. Delivery of a Product is subject to the availability of the Product and other events beyond the control of the Seller and delay may occur such that the delivery period stated is a mere estimate. You acknowledge that the time for delivery shall not be essential to the sales contract and that you shall not hold Seller liable should there be delay in the delivery of your Product.

3.4. Should the delivery of the Product fail due to your fault or negligence, Seller may terminate the Sales Contract without waiving any of its rights or remedies. 

4. Return & Refund Policy

4.1. Any deposit paid is non-refundable. In the case that customer fail to pay the balance of the amount of the Collection Receipt/Sales Invoice/Sales Order within 30 days from the date of the Collection Receipt/Sales Invoice/Sales Order OR refuse to take the ordered goods when it is delivered by Eracare Health Mart Philippines Inc., without any reason and continuously failing to provide an alternative date of delivery, Eracare Health Mart Philippines Inc., reserves the right to forfeit such deposit without further notice. 

5. Cancellation Policy

5.1. Should you have any cancellation, you may contact the Seller through the Gintell website, Lazada, Shopee, Facebook Instagram or in the authorized Physical Stores nationwide.

5.2. Within three (3) days from delivery of the Product and immediately upon discovery, you must contact the Seller as stated above and notify it of your complaint regarding any of the following:

  1.  the Product delivered is not the product you ordered;

  2.  the Product delivered does not correspond to the description listed on the Gintell website, Lazada, Shopee, Facebook Instagram or in the authorized Physical Stores nationwide for the product you ordered;

  3.  the Product delivered does not include the complete components or accessories specified on the Gintell website, Lazada, Shopee, Facebook Instagram or in the authorized Physical Stores;

  4.  the number of Products delivered does not correspond to the number of products you ordered on the Gintell website, Lazada, Shopee, Facebook Instagram or in the authorized Physical Stores nationwide; or

  5.  without your unreasonable use, there is a defect, malfunction or failure to conform to a warranty of the Product delivered.

5.3. Should you be entitled to a replacement product or to the delivery of an undelivered product and Seller be unable to comply for any reason or should Seller allow you a refund, Seller may provide you with a refund for the replacement product, the undelivered product or the defective or malfunctioning product. Any refund shall be conditioned upon your return, and our acceptance, of the Product. Seller will initiate a refund to your credit card (or original method of payment). You will receive the credit within a certain amount of banking days, depending on your card issuer’s policy. While Seller aims to effect a refund at the soonest possible time, the processing of your refund may take time. 

6. Limited Warranty

6.1. Eracare Health Mart Philippines Inc. warrants this product and parts thereof against manufacturing defects in materials or workmanship period for a period of one (1) year (unless stated otherwise) from the date of purchase by the purchaser, except for the extend appearance parts (i.e: backrest, headrest, footrest, casing, remote, controller, cabinets, knob, antennas, accessories, scratches, abnormal wear & tear, ageing).

6.2. During this warranty period, Eracare Health Mart Philippines Inc. will repair a defective product of part(s) without charges to the purchaser. However, if repair is to be carried out at a customer’s place, Eracare Health Mart Philippines Inc. may decide to charge transportation cost if it deems fit. 

6.3. Warranty will be void if;

  1. The serial number on the product has been removed, tampered or rendered illegible;

  2. The product has not been placed in normal living condition or subject to rough handling or misuse;

  3. The damage is directly caused by lighting, natural disaster, household pests attacks, wrong voltage, flood, fire, theft, negligence, accidents, improper maintenance, used not in accordance with the operation manual instructions furnished by Eracare Health Mart Philippines Inc. ;

  4. Product has been repaired, tampered with, altered or modified in any way by unauthorized person or technician; or

  5. Product has been used for commercial purposes.

6.4. In no event shall Eracare Health Mart Philippines Inc. be liable for consequential loss, incidental or accidental.

7. Title and Risk

7.1. Until the seller receives notification from the payment service provider you choose that it has received cleared payment (or a deposit of your complete payment for the product), you retain the right of possession or ownership in the product, even if it is delivered to a carrier for transmission to you. Up until the point at which ownership is given to you, the product is at the seller’s risk.

7.2. You agree to make sure that the product’s full payment is executed within a reasonable amount of time. Additionally, you agree to keep the product in good condition as the seller’s bailee and to respond to any inquiries from the seller or to any events that may impact the seller’s ownership rights in the product within seven (7) days of receiving them.

8. Limitation of Liability

8.1. In no instance shall the seller be responsible to you for any indirect, incidental, punitive, special, or consequential damages, or damages for lost revenue, profit, or use, resulting from or relating to these terms of sale. Seller’s liability for losses resulting from or related to these terms of sale shall not, to the extent permitted by law, exceed the purchase price of the product.

9. Contract Termination

9.1. Upon your request. Subject to Seller’s discretion, you may request to terminate the Sales Contract and Seller will strive to accommodate your request on a commercially reasonable effort basis.

9.2. Upon Seller’s determination. Without prejudice to any other right, Seller may terminate the Sales Contract by notifying you in writing at any time should any of the following happen or be present:
the Product becomes unavailable;
there was a mistake or error in the price listed for the product; or,
c. you wrongfully neglect or refuse to accept the Product or you are in breach of any other obligation under these Terms of Sale.

10. General Provisions

10.1. The agreement between you and the seller is fully expressed in these terms of sale. This Agreement shall take precedence over any earlier understandings, representations, or agreements, whether they were expressed in writing or verbally.

10.2. Any modification, waiver, or revocation of any provision or requirement in these Terms of Sale must be made in writing.

10.3. In the case of a conflict of laws, Philippine law shall apply and be followed in interpreting this Agreement.

10.4. If any portion of this Agreement is found to be illegal or unenforceable, that portion shall be deemed severable from the remainder of the Agreement, with the remaining portions remaining in full force and effect.
